Welcome to The Genius Village (“Company,” “we,” “us,” or “our”). By accessing or using our website TheGeniusVillage.com, mobile applications, or related services (“Services”), you agree to these Terms and Conditions (“Terms”). If you do not agree, please discontinue use of our Services.

1. Eligibility and Acceptance of Terms

You must be at least 18 years old or have parental/guardian consent if under 18.
Parents or guardians are responsible for supervising minors using our Services.
By using our Services, you agree to these Terms and all applicable laws.

2. Services Offered

The Genius Village provides:

Personalized Tutoring: One-on-one and group tutoring for K-12 and college readiness.

Subscription Plans: Flexible learning packages tailored to student needs.

We reserve the right to modify or discontinue any part of our Services at any time.

3. User Accounts

Registration: Accurate and up-to-date information is required.
Security: You are responsible for maintaining the confidentiality of your login credentials.
Termination: Accounts may be suspended or terminated for violations of these Terms.

4. Payment, Refund, and Cancellation Policy

a. Payments

All Services must be prepaid through our secure payment system.
Subscription plans automatically renew unless canceled before the renewal date.

b. Refunds

We offer a Money-Back Guarantee: If you are unsatisfied within the first 30 days or after completing 6 hours of tutoring (whichever comes first), you are eligible for a full refund.
Refunds are not available for completed sessions or accessed digital content.
Refund requests must be submitted in writing to support@thegeniusvillage.com.

c. Session Cancellations and Rescheduling

Sessions must be canceled or rescheduled at least 48 hours in advance to avoid forfeiture.
No-shows or cancellations after the deadline are non-refundable.
Unused tutoring hours may be converted into store credit but are non-refundable.

5. Scheduling and Session Policies

Booking: Sessions must be scheduled in advance through your account.
Rescheduling: Requires a minimum of 48 hours’ notice.
Tutor Assignments: We may assign or change tutors based on availability.

6. User Conduct

You agree not to:

Share your account credentials.
Upload harmful, offensive, or illegal content.
Disrupt or interfere with our Services.
Violate intellectual property rights.

Violations may result in account suspension or termination.

7. Intellectual Property Rights

All materials—including lessons, videos, and study guides—are owned by The Genius Village and protected by intellectual property laws.
You may not reproduce, distribute, or create derivative works without permission.

8. Communication Policy

By providing your contact information, you consent to receive communications via email, SMS, or phone for service updates and promotions.

To opt out of promotional messages, follow unsubscribe instructions or reply STOP to SMS messages.
Transactional communications cannot be opted out of.

Service Availability: We do not warrant uninterrupted or error-free access.
Limitation of Liability: We are not liable for indirect or incidental damages.

12. Indemnification

You agree to indemnify and hold The Genius Village, its employees, and affiliates harmless from any claims, liabilities, or damages resulting from your use of the Services.

13. Termination of Services

We may suspend or terminate your account without notice for violations of these Terms. You may cancel your account at any time by contacting us at support@thegeniusvillage.com.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of 1/10/2025. Disputes shall be resolved in the courts of Contra Costa County, CA.
